Exporting Encryption And U.S. Law

The Bernstein decision, an appeals court ruling, opens the door for free distribution of strong encryption software over the world wide web for people in the United States. Prior to this decision, the U.S. Commerce department would enforce the Exports Administration Regulations (EAR), which induced a prior restraint upon individuals wishing to publish their work over the web. Restraining of free speech by threat of legal action prior to the act of speech (e.g.- publication) is considered the most grievous form of first amendment violation in the eyes of the court, and acted as the crux of Dr. Bernstein's case against the federal government.
